Employee Investigations and Vetting

This should be read in conjunction with our services relating to ISO 37008 Internal Investigations.

Particularly in a post-pandemic world, and in the light of increasing national, international and global legislation, liability, regulation and compliance, the need for independent experience and expertise in all aspects of employee/workplace investigations and employee vetting could not be more important.

Are you familiar with and able to understand, consider and deal with any or all of the following “minefield” issues?

  • Criminal, regulatory, financial and reputational risk and consequences.

  • Fitness to work.

  • Employee monitoring and legal implications.

  • Environmental, Social, and Governance (ESG), including diversity, inclusion and equality.

  • Right-to-work checks/clarifications and legal updates.

  • Fraud and criminal activity.

  • Harassment and bullying.

  • Grievances.

  • Whistleblowing.

  • Complaints.

  • Confidentiality.

  • Legal and other privilege.

  • Legal representation.

  • Employment law.

  • GDPR/data protection law.

  • Human Rights Law (EU and Council of Europe).

  • “Statutory defences”.

  • Data Protection Commission.

  • Information Commissioner’s Office.

  • Training.

  • Workplace Relations Commission and ACAS Guides.

  • Strict liability corporate offences and “failure to prevent fraud” liability.

Consider:

  • Are employees and job candidates lying to you?

  • Is your employee really sick and unfit to work?

  • Is the employee making a personal injury claim?

  • Have you carried out full and proper due diligence on prospective employees?

  • Is the job candidate who they say they are?

  • What does a job candidate’s CV or Resume NOT tell you?

  • Have you checked their past and current social media profile?

  • Are you aware of possible unconscious bias towards job candidates and employees?

  • Do not be unduly influenced by the HR Department!

  • Are you seeking Truth? Justice? Or Resolution?
